MyCBTL Rewards Program Terms of Use

Programme Overview
- The MyCBTL Rewards Program (“Program”) is a rewards program offered by The Coffee Bean & Tea Leaf (M) Sdn. Bhd. (“The Coffee Bean & Tea Leaf”, “we” or “our”) to customers located in Malaysia.
- The Program shall be governed by these Terms of Use. By applying for membership in the Program and accessing or participating in it, you agree to be bound by these terms of use and all terms incorporated herein by reference, including any amendments to these Terms of Use that The Coffee Bean & Tea Leaf may make in its sole discretion from time to time without prior notice to you.
- By successfully signing up as a member to the Program, you (“Member”) are deemed to have read, understood, accepted and agree to be bound by each term and condition as contained in these Terms of Use. The Terms of Use stated herein constitute a legal agreement between you and The Coffee Bean & Tea Leaf.
- By signing up, you agree that it is your responsibility as a Member to keep yourself updated with the Terms and Conditions (as amended). Any continued participation as a Member after any amendments to the Terms of Use shall constitute consent, acceptance and affirmative agreement by the Member to the Terms of Use as they exist from time to time, including, without limitation, the amended Terms of Use. The Coffee Bean & Tea Leaf shall not be held liable for any loss, damage or expense accrued (regardless of whether The Coffee Bean & Tea Leaf receives prior notice or advice of the possibility of damage) as a result from any Amendments to the Program or these Terms of Use.
- If you do not agree to all of these terms, do not access or participate in the MyCBTL Rewards Program.

Membership Eligibility& Registration
- Membership to the Program (“Membership”) is limited to individuals only and is limited to one account per individual.
- All applicants must be ageeighteen (18) years or older to be eligible for Membership.
- To enroll in the Program and receive program benefits, you will first need to create a MyCBTL account (“Account”). You can do so via the MyCBTL Mobile Application distributed by The Coffee Bean & Tea Leaf in Malaysia (“Mobile App”).
- The MyCBTL accountregistration process may require that you provide certain personal information, including: email address, name anddate of birth, and your marketing preferences.
- Each account is unique and non-transferrable. Member shall not create multiple accounts using different email addresses or credentials and The Coffee Bean & Tea Leaf has the right to terminate or suspend all related accounts without prior notice if such activity is detected.
- Members are not able to change the email address associated with their account.
- Members can edit their personal information, excluding date of birth, via the Mobile App.

Earning Bean Points
- You will earn five (5) Bean Points (“Points”) for every one (1) Malaysia Ringgit (RM) you spend, after any applicable discounts but before Sales & Service Tax (SST).
- You can earn Points for purchases made through the Mobile Order and Pay (“Mobile Order”) functions of the Mobile App, and at all participating "The Coffee Bean & Tea Leaf" cafés in Peninsular Malaysia, excluding Kuala Lumpur, Putrajaya & Selangor (see list of participating cafés here). No Points will be awarded on taxes, tips, charitable donations and delivery fees.).
- To earn Points in store, you must present your account QR code that is generated in the Mobile App and scan it at the time of purchase.
- Points earned will be rounded down to the nearest whole number depending on the value of your purchase. For example: if you spend RM16.90 before SST, you will earn 84 Bean Points.
- For cancelled orders, the Points earned for that purchase will be deducted from your account and any vouchers utilized/issued will be reissued to/deducted from your account. Bean Points deduction and reissuance/deduction of vouchers may take up to 7 business days processing time.

Rewards Redemption
- Bean Pointscan be used to redeem for reward vouchers (“Rewards”) listed in the Redeemable Vouchers section in the Mobile App (“Rewards Catalog”).All rewards redeemed cannot be refunded or exchanged for cash. For full Terms & Conditions relating to the specific Reward, please refer to the Terms & Conditions accompanying each Reward.
- The Coffee Bean & Tea Leaf may adjust the rewards at any time in its sole discretion and without prior notice. Please refer to the Rewards Catalog for the updated list of available Rewards.

Rewards Utilization
- You may utilize your Rewards on purchases made via the Mobile Order function of the Mobile App, and at all participating "The Coffee Bean & Tea Leaf" cafés in Peninsular Malaysia, excluding Kuala Lumpur, Putrajaya & Selangor (see list of participating cafés here).
- You may only use one (1) Reward in a single transaction. For example: You have 2 Rewards to be utilized and there are 2 eligible items in your transactions. You can only utilize one (1) Reward in the transaction.
- Rewards cannot be used with any existing promotions, offers, privileges and discounts, unless otherwise stated.
- Unutilized Rewards will no longer be valid for use upon expiry. Any request for extension will not be entertained. For the expiry date associated with each Reward, please refer to the Terms & Conditions accompanying each Reward.

Bean Points expiration

Points earned will expire in 12 months at the end of the equivalent month in which they were earned. For example: You earn 50 Bean Points on 15 October 2024 and 200 Bean Points on 25 December 2024. The 50 Bean Points earned on 15 October 2024 will expire on 31 October 2025, and the 200 Bean Points earned on 25 December 2024 will expire on 31 December 2025.

The Coffee Bean Card (“TCB Card”)
- The TCB Card will no longer be valid for use after 31 December 2024. The stored value credit in the TCB Cardand the Bean Points earned from the TCB Card(“TCB Bean Points”) are valid for use until 31 December 2024 only. Any extension will not be entertained.
- TCB Bean Points arenon-transferrable to the MyCBTL program.

Deletion of account
You may request to delete your account via the Mobile App or by contacting us at https://www.coffeebean.com.my/contact-us. It may take up to 30 working days to process the termination of your account. Please note that all account termination requests are final and irreversible once processed. Once your account has been successfully terminated, all information and benefits associated with your deleted account will not be accessible or recoverable, including your account history, Bean Points and Rewards.

Amendments and Termination of the Rewards Program

The Coffee Bean & Tea Leaf has the right at any time, with or without giving you prior notice, to:
- (a)change, modify and/or end or cancel the Program and/or any specific Reward;
- (b)change any Reward or other Program benefit we offer;
- (c)change the requirements for earning a particular Reward;
- (d)change the time you have in which to earn a particular Reward;
- (e)change any other feature of the Program; and/or
- (f)suspend or terminate any account and/or your participation in the Program.
- Any changes or modifications are effective immediately upon posting to the https://www.coffeebean.com.my/ website, and/or, the Mobile App. If we end the Program, Rewards you have earned but not used will expire on the Program end date, and you may not redeem any Rewards after the end date.

Limitation of Liability
- (a)Members of the Program assume all risks and liabilities for loss or damage arising from his or her participation in the Program.
- (b)In no event shall The Coffee Bean & Tea Leaf 's total liability to you for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence) or otherwise) exceed the amount paid by you to The Coffee Bean & Tea Leaf, if any, for using the Account, the Mobile App and/or the Program.

Indemnity Each Member shall indemnify and hold The Coffee Bean & Tea Leaf and their respective directors, officers, employees, agents and contractors harmless from and against any and all claims, proceedings, loss, damage, costs and expenses (including legal costs on a full indemnity basis) incurred, suffered or sustained by The Coffee Bean & Tea Leaf and their respective directors, officers, employees, agents and contractors directly or indirectly arising from or relating to the Member’s participation in the Program.

Assignment
- (a)No Member may transfer or assign his or her rights under the Program, unless with the permission of The Coffee Bean & Tea Leaf.
- (b)TheCoffee Bean & Tea Leaf may at any time assign to any party all or any part of its rights and/or obligations under these Terms relating to any Account and/or the Program without the prior consent of any Member.

Third Party Rights Save as expressly stated otherwise, no third party shall have any right to enforce any provision of these Terms of Use.

Waiver Any provision under these Terms of Use may be waived if, and only if, such waiver is in writing and signed by parties waiving the breach. The rights and remedies herein provided shall be cumulative and not exclusive of any rights or remedies provided by law.

Severability The invalidity or unenforceability of any provision of these Terms of Use shall not affect the validity, legality, or enforceability of the remainder of these Terms of Use in any way. In the event any of the provisions of these Terms of Use is held by a court or tribunal of competent jurisdiction to be unreasonable restraint of trade, void for public policy reasons or otherwise unenforceable, such provision shall be deemed to be severed from these Terms of Use and the remaining provisions of these Terms of Use shall remain in full force and effect and shall be construed as if such invalid or illegal or unenforceable provision had never been contained herein. It is intended that all rights and obligations of the Parties hereunder shall be enforceable to the fullest extent permitted by law.

Governing Law and Jurisdiction This Agreement shall be governed and enforced in accordance with the laws of Malaysia. The Parties agree to submit to the exclusive jurisdiction and venue of the Malaysian courts in respect of all matters relating to these Terms of Use.

Notices All notices, requests, demands or other communications which are required to be given pursuant to the terms of these Terms of Use shall be in writing and delivered to the last known address of the Parties appearing in The Coffee Bean & Tea Leaf’s records, by hand or by courier or e-mail and shall be deemed to have been duly given: (i) on the date of delivery if delivered by hand; (ii) upon the date of the courier’s/ postal departments verification of delivery at the specified address if sent by an internationally-recognized express courier or registered post, or (iii) at the time of sending if sent by e-mail to the designated e-mail address of the other Party without receipt of a transmission failure notice.

Entire Agreement These Terms of Use constitute the entire agreement between the Parties and supersede all prior agreements, understandings, negotiations and discussions, whether oral or written, between the Parties with respect to the subject matter hereof. Each of the parties acknowledges and agrees that in entering into these Terms of Use, it does not rely on, and shall have no remedy in respect of, any statement, representation, warranty or understanding (whether negligently or innocently made) of any person (whether a party to these Terms of Use or not) other than as are expressly set out in these Terms of Use.
